General Terms & Conditions

Subject matter of the contract

BAWI-TEX AG sells the goods to the customer (hereinafter referred to as "customer") subject to the following terms and conditions of delivery and sale (GTC).

Conclusion of contract

The contract between the customer and BAWI-TEX AG is only concluded when an order is placed by the customer and accepted by BAWI-TEX AG. The customer's order is placed by telephone, in writing or via the Internet. BAWI-TEX AG accepts the order by (a) sending the customer an order confirmation (e-mail or letter post) or (b) delivering the ordered goods (incl. delivery note).

Retention of title

The delivered goods remain the property of BAWI-TEX AG until full payment has been received. The latter is authorised to make a corresponding entry in the retention of title register. If the customer defaults on payment of the purchase price, BAWI-TEX AG is authorised to withdraw from the contract (declaration of withdrawal) and take possession of the goods.

Warranty for defects and liability

The warranty period for all products offered is 24 months from the date of purchase, unless a longer warranty period is expressly stated. Products will be replaced or repaired free of charge if the defect is reported by the customer within 14 working days of receipt of the goods. If a product can no longer be repaired or replaced, an equivalent replacement product will be exchanged or a credit note issued to the customer. The warranty is void if changes or repairs are made to the goods without the written consent of BAWI-TEX AG. To the extent permitted by law, liability for damages is excluded. In particular, BAWI-TEX AG is not liable for damages that are attributable to improper use or natural wear and tear or for damages that have not occurred to the delivery item itself (consequential damages).

Exchange and return policy

You have 14 days from the delivery date to return the items you do not like to us in perfect new condition and in the original packaging at your expense.
After receipt of the goods, any purchase price already paid will be refunded to the customer's bank account. However, we reserve the right to deduct the purchase price to be refunded or to invoice the customer for any damage.

Intellectual property

BAWI-TEX AG reserves all rights for every design, every text, every graphic on its website. Copying or any other reproduction of the entire website or parts of this website is only permitted for the purpose of placing an order with BAWI-TEX AG. BAWI-TEX AG reserves the property rights and copyrights to illustrations, drawings and other documents. The customer requires the express written consent of BAWI-TEX AG before passing them on to third parties.

Place of jurisdiction and applicable law

These GTC and the contracts concluded on the basis of these GTC are subject to Swiss law. The place of jurisdiction is Schwyz.

Final provisions

For the sale of the goods specified by BAWI-TEX AG, the GTC apply exclusively in the version valid at the time the respective contract is concluded. These terms and conditions apply in particular even if they differ from those of the customer. Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the legal validity of the remaining provisions. Furthermore, BAWI-TEX AG reserves the right to amend these General Terms and Conditions at any time.
